“The line between defamation and criticism is quite thin,” the Delhi High Court observed on Thursday while hearing a plea filed by Rajya Sabha MP Raghav Chadha alleging violation of his personality rights through AI-generated deepfakes, manipulated videos, and allegedly defamatory social media content.

The matter came before the Court after Chadha approached it claiming that several online posts and digitally altered videos were circulated targeting him over reports and political commentary surrounding his alleged shift from the Aam Aadmi Party (AAP) to the Bharatiya Janata Party (BJP). The plea sought protection against what was described as misuse of artificial intelligence tools to create deceptive and harmful content capable of misleading the public and damaging his reputation.

During the hearing, the Court expressed prima facie reservations regarding the nature and scope of the reliefs sought and highlighted the need to carefully assess the balance between an individual’s right to reputation and freedom of speech and expression. The Bench noted that criticism of public figures and political commentary occupy a protected space in democratic discourse, while also acknowledging that false and manipulated content raises emerging legal concerns.

The Court’s observation that the boundary between criticism and defamation remains narrow reflects an ongoing judicial challenge in the digital era, where political expression, satire, commentary, and technological manipulation increasingly intersect. The proceedings also bring attention to broader questions around personality rights, accountability of online platforms, and the legal framework governing AI-generated content in India.

The matter is expected to be taken up further as the Court examines whether the content in question crosses the threshold from permissible criticism into actionable harm.
